Easement #372086 was recorded on December 5th, 2017 at 1:32 p.m at the Carbon County Clerk and Recorder’s Office. (Pictured Below) Who prepared this Easement? It is not in the style and format of Town Of Fromberg Attorney Hope Freeman. Why didn’t Attorney Freeman prepare it? Did Attorney Freeman sign off on it? Easement specifies in upper left hand corner (in handwriting no less): “Wayne F. Vargas, P.O. Box 496, Fromberg, MT 59029”. This Easement seems non-specific. Would it hold up in a court of law? Document #372086, Page 1, Paragraph 2, Final sentence refers to : “Exhibit A”. Document #372086, Page 2 is labeled as: EXHIBIT “A”. That alone might render this Easement null and void. It only contains a metes and bounds legal description. No specific survey monuments are delineated. Obviously a professional land survey was not done. Not even a “location of pins” survey. EXHIBIT “A” shows no compass north icon. EXHIBIT “A” is not dated. EXHIBIT “A” shows a “pie shape”. EXHIBIT “A” “pie shape” is not labeled. Neither is the EXHIBIT “A” “pie shape outline” labeled. Could a metes and bounds description even adequately address “an arc” let alone the “contour of the ball field.”? (Said language is included briefly herein, but in its entirety below); “easterly 82′ along the north property line, then in an arc, following the contour of the ball field, to a point that is along the west property line then northerly1 10′ along the property line, back to the point of origin, as shown on EXHIBIT “A”. THERE IS NO POINT OF ORIGIN SHOWN ON EXHIBIT “A”. The language “northerly11 10′” attests to the lack of detail with regard to the preparation of EXHIBIT “A”. Historically these types of documents would be requested and vetted by the closing agent. Who was the Closing Agent? Carbon County Abstract Title Company, Red Lodge, MT was involved in this transaction. Title companies generally have very specific requirements with regard to easement preparation, execution and recordation thereof.
I just want to Thank , the Admin. for their hard work on this . And letting the people know how we are getting shafted , by our own Town council.
There seems to be an incredible lack of knowledge and transparency from city hall. We would like to believe that the mayor would want all of this to be very clear and direct. Information given out to the public with well laid out outlined explanations. If that were the case tho, then it becomes impossible to shove the elephant back in the closet! (Shirley’s motion to approve the sale). It’s amazing how some people sleep at night!
