The Town of Fromberg has retained and will pay for a survey of this property. I will not run from the responsibility of stating I had looked at that property with our PWD at the time. We went and looked at it long before it was purchased, the PWD employee stepped of the setbacks and the potential buyer explained what he wanted to do. The statement of some, that he was building on city property was , as far the information received from realtors and from my own property deed, is misinformation. The city does not have a deed to or pay taxes on that easement. The property owner owns and pays taxes on it and maintains it, the Town has been granted an easement for future utilities, etc. He is, in fact, encroaching on that easement, which could be taken care of by a simple variance. It would not set a precedence, as each application for a variance is reviewed on its’ own merit and approved or not on that information. Yes, it is a large building and it does encroach on the easement by about 10′ as do the line of trees that were planted many years ago. Be that as it may, we will do everything we have legally and move forward.
