Brief Excerpt Discussion of “Old Business” With No Specific Items Listed Violates The Public’s Right To Know…


A discussion regarding Mr. Lee’s Variance Request was held at the TOF 11.10.2020 Council Meeting under “Old Business”, when in fact no such topic was listed under “Old Business” per TOF’s 11.10.2020 Agenda pictured below. The following two brief You.Tube videos document said discussion:

  1. These idiots violate MCA at almost every single meeting. This particular violation is MCA I7-3-4220. ‘Council meetings’ also covers regular council meetings. If the clerk knew any part of her job, old business or new business would not have been placed on the agenda, as no specific items were listed. Two years on the job, a $2.50 hourly raise and still not a clue! How much money have we sunk into attorney fees, and she still has no clue on agendas or much of anything else! Then you have Nottingham, half dozen years on the council and as clueless as ever! Miller, who for years has been in City Government, on Council, and as Mayor, continuously consults the Town attorney every chance she gets and yet remains clueless. The Town budget is very tight, we can’t afford all those dollars being spent on attorney fees for people who are unwilling or incapable of learning! So, can a item be discussed when it was not placed on the agenda? No. The right to observe the decision-making activities of a public body is conditioned on the public having advance notice of all of the topics to be discussed. That’s the purpose of the agenda. When a body discusses matters which were not on the agenda, both the public’s right to observe and the right to participate have been violated. In other words, you have violated individuals Constitutional Rights. Which seems to be an on-going thing at City Hall! The reason I find this so unbelievable is that its just common sense, especially if you have the slightest clue on Roberts Rules of Order. Public Comment however does give an individual the right to voice an opinion or comment on those items not on the agenda pertaining to the Town. Stop, listen and think!
