Zoning Quagmire

Per our previous post entitled: “TOF 2-5-2018 Council Meeting Agenda posted at mail time on 2-2-2018” we offer Item “8 Zoning Lloyd MacKenzie” a photo of which is included below. Also shown below is: Warranty Deed  #372447 dated 1.10.2018, recorded  on 1.16.2018 at 4:16 p.m. Fee Simple Title is granted in this deed from Planet Home Lending, LLC to Sarah G. Mackenzie for the real estate described as: Lot 13, Block 2 of the Blewett First Addition to Fromberg, Montana. Therefore, Sarah G. Mackenzie is the Owner of Record. Therefore any Zoning Variance Application put forth and signed by LLoyd Mackenzie would render said application null and void.

  1. Yes! This entire process would’ve been made null and void at its onset had Mayor Miller done her due diligence and researched this! Now I’m questioning several other legal points as to whether Mayor Miller should have even approved this application? If the information she presented to Town Council was inaccurately represented, doesn’t she herself become legally culpable? Exactly how much information did Miller choose to withhold? Even a small item could show intent to deceive! If you viewed the February 2018 YouTube Council Meeting video, Miller is adamant that everything on this property fits within the confines of our zoning ordinances! When questioned about fire truck access and other concerns, Miller reassures Council members that all is ok with the application. Yet, her interpretation of Grandfather Clause is misrepresented and inaccurate. Begs the question; how much more of what she is saying is falsified and unverified?
