Barley Field Fiasco – Who Prepared this Warranty Deed?

Warranty Deed #372085 was recorded on December 5th, 2017 at 1:31 p.m at the Carbon County Clerk and Recorder’s Office. (Pictured Below) Who prepared this Warranty Deed? It is not in the style and format of Town Of Fromberg Attorney Hope Freeman. Why didn’t Attorney Freeman prepare it? Did Attorney Freeman sign off on it? Deed specifies it is to be returned to: “Wayne F. Vargas, P.O. Box 496, Fromberg, MT 59029”. Lower left hand corner states: “2218.000- PL 269212.  Lower right hand corner states: “WARRANTY DEED – PAGE 1 OF 2”, both of which are indicative of a “form deed” downloaded from the internet or from a generic book of forms. Historically these types of documents would be requested and vetted by the closing agent. Who was the Closing Agent? Carbon County Abstract Title Company, Red Lodge, MT was involved in this transaction. Title companies generally have very specific requirements with regard to deed preparation, execution and recordation thereof.

  1. Historically, Title Companies provide Title Insurance. Some may also provide Closing Services. They don’t “write” deeds; they generally request lawyers to “prepare” them. Some Title Companies may be large enough to have an attorney on staff, most firms in our County of Record: Carbon County, Montana, do not.

  2. “Zoned City Res” grab a half a brain would ya or educate yourself. Title companies use an attorney. In some cases it is the buyer’s attorney of choice or perhaps the Seller’s attorney. You have obviously stretched your mental capacity well beyond its limits!

  3. Well Sparkle, I guess it doesn’t matter anymore, because I heard the barley field is for sale….for much much more than it was sold for…stick that in your limits.

  4. Well Zoned, that doesn’t surprise me at all! You see it was purchased for way under market value. That would be thanks to that motor mouth that’s now our Mayor.That’s generally what happens when people get a good deal, they flip it. As for Motor Mouth, this was just the start of her reign of terror!!! From what I understand, she’d been on the zoning committee but had not a clue as to how that property should be sold! Not a clue as to the impact this placed on the community! Then she took it upon herself with that last zoning deal to screw some more of us over! In her ignorance she whines like SHE’S mistreated, but what she has done will effect all of us long after she’s left office. So I do believe she has tainted the community,

  5. Zoned FYI if it does sell it might pay for the mayor to buy a helmet and join the track team! I wonder how her juggling skills are, maybe she could join the circus, we could give her a recommendation!!!

    • Mayor may want to line up a Bail Bondsman too! Seems there was a 2 Year Provision for the GLORIOUS, UNSURPASSED, HERETOFORE UNHEARD OF COMMUNITY GARDEN that the OUTSTANDING VARGAS DYNASTY was going to feed America with?!!!? Or was that just some other part of the loose paperwork process? Hope the Mayor looks good in stripes! Dimestore novels aren’t this entertaining.
